From the declaration of National Human Rights Commissioner (NHRC) of Thailand on 20th  June 2011, Thailand is one of the countries which realizes the Refugee Rights, compiles the fact and coordinates with all concerning organizations for solving and protecting the refugees.




NHRC of Thailand announced as the World Refugee Day which fall on every 20 June each year that the right to escape from persecution is a basic human right following the Universal Declaration of Human Rights and International Human Rights Law.
Although Thailand haven’t yet applied to be an associate member to the Convention relating to the Status of Refugees A.D.1951, but cannot deny basic human rights and respect of the principle of non-repatriation.

According to NHRC inspection on complaints of Ahmadiyya refugees who detained in the cell of Immigration Bureau in various areas and in shelters of refugees from neighboring countries that 96 Ahmadiyya refugees were bailed out the past 6th June 2011, it appeared that Ahmadiyya regufees still have been arrested continually.

NHRC mentioned that since Thailand did not have the directly domestic refugee law and  immigration laws did not contain the specific provisions about management of refugees in Thailand, the said 96 refugees were arrested on charges of illegal immigration, illegal resident in Thailand, or overstaying from the permitted period. NHRC further added that Thailand was an associate member of the Convention on the Rights of the Child but children under 18 years still had not been repatriated and detained in the event on 6th June 2011; therefore, it should have monitoring measures and other ways where children shall not be detained in the area of immigration detention.

For the effective resolution of this problem, NHRC proposed to reform the relevant immigration laws, especially the amendment on Immigration Act B.E.2522, ministerial regulations and Immigration Bureau’s regulations conforming to situations of globalization; in addition, All principles and procedures should follow International Human Rights Standards and manage systematically and fairly all refugees including allowing participations of the United Nations agencies.

While Thailand still has not reformed of relevant laws and acceded to the Convention relating to the Status of Refugees, NHRC requests the Thai government and relevant institutes to discuss legal residence of refugees and coordinate with United Nations High Commissioner for Refugees (UNHCR) with civil society organizations to bring refugees to report and record their history at the Immigration Bureau and treat them under fundamental Human Rights until they are able to leave Thailand.
